Child Custody Grandparents
After the decision taken by the US Supreme Court in Troxel case, visitation and child custody grandparents rights are being determined based on the best interests of the grandchildren. Factors such as the pre-existing relationship between the child and the grandparent and the reason for the parents? objection often determine the level of visitation rights and child custody for grandparents seeking court ordered times to be with their grandchildren.
Today, all states have statues authorizing a court to award visitation to a grandparent under certain circumstances. For example, California requires two prerequisite findings before granting visitation rights to a grandparent. First, there must be a preexisting relationship and bond between the grandparent and the grandchild and second, the requested visitation must be in the best interest of the child. If the prerequisites are found, the court must also balance the interest of the child in having visitation with the grandparent against the right of the parents to exercise their parental authority. Family Code ? 3103 (a) (2).
In contrast to California, Virginia has a broader law allowing child custody grandparents visitation rights to be petitioned in the court even when the parents and children are in an intact household. Virginia?s Supreme Court rejected a challenge to its third party visitation law, on the grounds that it interfered with a parent?s fundamental constitutional right to autonomy in child rearing. The court held that the statute would be constitutional even as applied to intact families if visitation were ordered even over the objection of a parent on a showing that the child would be harmed without such visitation (Williams vs. Williams).
However, Virginia is in the minority. Most state courts do not permit a grandparent to petition the court for grandparent visitation rights if the family is still intact. The intent is to preserve the parents constitutional right of privacy and autonomy in child rearing. For example, Illinois recently upheld the constitutionality of its grandparent visitation law which allows an award only when the family is not intact. The statue allowing grandparent visitation only for non-intact families was not a violation of the equal protection clause of the constitution (West vs. West).

The documents represent "a rare glimpse behind the wall of a key climate denial organisation," Kert Davies, director of research for Greenpeace, told?The Guardian.
Whatever Heartland is doing, it seems to be working. Americans once largely embraced the science behind global warming, but no more. According to Harris interactive, in 2007, 71 percent of Americans believed that human activity was changing the Earth's climate. By July of 2011, that number had fallen to ?44 percent.
Climatologists are mostly believers. Another Harris Interactive poll found that 97 percent of climatologists believe that global temperatures have increased in the past century. And 84 percent of these experts credit humans with causing the temperature increase. Scientists are still trying to understand the details of humans' impact on climate, what it means for the future and how to mitigate its effects.
But among most Americans, but belief ? or disbelief ? in climate science seems to be shallow, and it is largely driven not by?science or scientists, but by politicians. A study published online in the journal Climatic Change last year, demonstrated that belief in climate change and its anthropogenic causes peaked in 2006-2007. The study suggests that this belief was due in part to congressional agreement on the issue.
The release of Al Gore's movie, "An Inconvenient Truth" in 2006 also helped, as did the relatively stable economy.
But in 2008, the economy began to falter the consensus among political leaders dissolved. At the same time, a growing number of Americans began to embrace climate skepticism.?
Ohio State University sociologist?J. Craig Jenkins, noted that one thing is clearly not influencing people's beliefs on climate change: science.?
"There is no linear process where people get educated about the threat and then demand action.? People?s views fluctuate quite a bit, and [a] lot has to do with what they hear from their political leaders.?It is a political battle," he said in a press release.?
As for the Heartland Institute, they describe the impact of their work in this way: "A telephone survey of randomly selected state and local elected officials conducted in 2011 found 79% of state legislators and 63% of local elected officials read at least one of our publications. 45% of state legislators say a Heartland publication changed their mind or led to a change in public policy."
The organization influences opinion by providing funding to experts and bloggers, holding an annual climate change conference, and publishing responses to reports produced by the Intergovernmental Panel on Climate Change (IPCC) through a group called the Nongovernmental International Panel on Climate Change (NIPCC). The Heartland Institute's communication tools emphasize areas of doubt and uncertainty in climate research.
An article published in July in the journal Nature said, "the Heartland Institute and its ilk are not trying to build a theory of anything. They have set the bar much lower, and are happy muddying the waters."

Family Organization ? Wilke Family
When Mallory started kindergarten I didn?t realize how much it would change our home life. I figured it would be mostly like preschool, but going more days. Boy, was I wrong. The influx of papers, the homework to do, her schedule and the tasks to keep up with and remember. I felt like I was just barely keeping up with it all, and not going a good job at that.
At the start of this year I knew I needed to do something about it. I needed a way to organize the girls incoming and outgoing items and to create storage for many items to save my sanity.
These are my solutions.
In the hallway by our backdoor, I created a family command & communication center. I couldn?t find a complete solution from any one store, so this is a conglomerate that works really well for us.
The left section is Mallory?s (the kindergartener), the middle is Chelsea?s (preschool) and the right is Tessa (starts preschool in the fall).
I knew I wanted an IN and OUT box for each girl, so?I got the Daily System Letter Bins in white (which is really off white and what I wanted) from Pottery Barn. The girls put their school papers, folder and books in the IN (bottom) bin when they get home from school. Once we do homework, read the book, do what needs to be done with the paperwork, it goes in the OUT (top) bin. This has made getting out the door in the morning so much easier.
Below the bins, I added hooks where backpacks and jackets get hung up (and they do!).
Above the Letter Bins, I made a cork board for each girl. Pottery Barn has cork boards with their Daily System but they are much too small for what I wanted. I knew I wanted space where three vertical letter size pieces of paper would fit. I couldn?t find anything like to buy (which I would have preferred), so I had to make this with 12?x12? (1/2?) cork tiles (purchased here). From the little research I did on cork tiles, I discovered that you can?t just stick them to the wall if you want them to stay long term. So, I got some hardboard/masonite pieces cut to 12?x36? from Home Depot and then used Gorilla Glue to adhere the tiles to the board. I then used anchors, screws and washers to attach my cork boards ?to the wall.
On the cork boards, I use the top 12? square to display current artwork. In the bottom two 12? squares, I tack up important papers that I may need to reference later (schedules, reading logs, reminders, etc.). I was having a hard time keeping up with those papers for the first part of the year and now I know where to post and find important information. Oh, and Tessa?s cork board (right) has miscellaneous artwork and papers tacked to it, just for fun.
I also got some wooden letters to add above each cork board, but I need to paint them before hanging them.
The next thing I wanted to do was create and post a schedule for our family. I thought this might help get us organized and stay on track with certain tasks. I got some ?chalkboard? contact paper and adhered it to the cabinet that surrounds our fridge. On the top I posted our schedule, using a chalk marker. On the bottom, I made a chore chart. The schedule is very ambitious and we haven?t followed it completely on any one day yet. It helps me by reminding me what needs to be done each day. It has really helped me in the mornings and we are getting to school five to ten minutes earlier than we used to.
As for the chore chart? it is a bit of a chore to keep up with it. I think if I followed through with it more, the girls would really get into it and do the things I?ve asked of them. But, most days we are too busy or I am tired or my patience has worn thin, so the things don?t get done or they get done and not marked off.
I didn?t photograph this, but I also added a little square of chalkboard contact paper to the front of the fridge (I did this after I took these pictures). On that ?chalkboard? I post some of my goals for the week and month. This has been a big help for me and I?ve already accomplished several items on my TO DO list (items that normally would just sit and sit on my list).
I also want to add that I really like the chalk markers. From what I understand, you shouldn?t use them on a traditional chalkboard because it should be used on nonporous surfaces (like the contact paper, mirrors, glass, etc.). The markers wipe mostly off with water and then with a little 409 or Windex, the rest of the paint comes off completely.
The third aspect of our get organized plan involved creating a homework station. In our kitchen, we have this cabinet (pictured above, on the left) where we used to store the girls? crayons, markers, coloring books, stickers, craft supplies, etc. (behind the doors). This solution wasn?t working for me anymore because it was too hard for the girls to get what they wanted without creating a mess and then it was always a struggle to get them to put everything away.
I found a better solution in the?Stanton 6+1 wide Rolling Cart??from Home Decorators Collection (on sale + free shipping). This is piece, on the right, is made with real wood, comes assembled and is nice quality. There are several different options for the cart (colors and number/configuration of drawers). It comes with wheels but we?re not using them.
On top of the rolling cart I added a quality?pencil sharpener (I didn?t realize it was so big when I ordered) and a wire basket. The wire basket holds papers that the girls are working on or have finished. I hope to go through the papers once a week or so to make sure there aren?t any keepers before throwing most away. In the drawers, are their supplies:
- Drawer 1: rulers, stapler, tape, glue sticks, erasers, hand pencil sharpener (for colored pencils since they can break the electric one)
- Drawer 2: colored pencils, crayons, specialty markers
- Drawer 3: small white boards, white board markers, white board eraser
- Drawer 4: white paper
- Drawer 5: construction paper
- Drawer 6: stickers sheets, sticker books
- Drawer 7: coloring books
I?m sure as the girls get older, the items in the cart will change, but this is what is there now. This little cart has been a great addition to our home. The girls can get things out and put them away so much easier.
In the bottom of the cabinet (on the left, above) where their supplies used to be stored, I am storing other art, craft and school supplies: Play-doh, paint, brushes, beads, pom-pons, stencils, educational workbooks, etc.. The supplies in the cabinet are used infrequently and with parental supervision, so the cabinet has more of chance to stay organized now.
The other thing that I added to the area (but didn?t photograph) is a black?Bedford Lazy Susan ?(pencil holder) from Pottery Barn. It sits in the middle of our kitchen table and holds the girls? pencils, markers, colored pencils for Tessa and sometimes scissors (if the girls aren?t on restriction from them; they currently are because they create the biggest messes after using scissors and they don?t like to clean up the paper scraps. No clean up? No scissors.). When we eat dinner, the Lazy Susan sits atop the Stanton Cart in the wire basket.
So, my attempt at getting us organized is helping me; some solutions more than others. I just wanted to share in case anyone else out there is looking for a way to calm the chaos in their homes.

Not only that, the two of you can trade tips. Stuffing steel wool into holes or cracks that mice might be using is a temporary yet effective solution. Mice are unable to chew steel wool, so they will be trapped in their hole.
If you want to renovate your home, deal with any electrical or plumbing issues in the home first. Do any work that requires access to the inside of your walls first before starting the other projects. Once your walls are already open, it is much easier to tackle general maintenance to wiring or plumbing. When woodworking, always use the proper equipment to take measurements or judge whether a surface is level ? don?t rely on your eyes. Use a level, speed square, and tape measure for accurate woodworking.
Start planning your DIY projects well before you start them. If you immediately start exploring all of your options, you will be able to build up a wider and more carefully chosen array of possibilities. Your home improvement agenda will be easier to accomplish if you are not exasperated by time limitations. When partaking in a large home renovation project, you should be honest about your budget to your contractor. Being honest will allow your contractors to be able to use better quality materials for your renovation. In addition, the contractors will get more value for their money. This is a win-win situation for both parties. TV entertainment stands cost quite a bit of money. A great viable alternative to those expensive stands is buying a nice dresser. You can put your TV Cheap Bar Stools on top and use the dresser drawers to store your DVDs and CD?s. Your remote controls and electronic manuals can also be stored in a drawer preventing it from being an eyesore.

Good art rarely dies? | Orbit Books | Science Fiction, Fantasy ...
?it just gets refracted.
It?s a little amusing to hear some people who read my new novel The Troupe say that they?ve never heard of vaudeville.
Of course they?ve heard of vaudeville. Everyone?s heard of vaudeville. They probably just don?t know it yet.
Part of the problem is the term itself: ?vaudeville? is a vague word for a vague era. It refers to a period in American history ? before radio, and definitely before the advent of film ? where the only entertainment you could really ever see was on the stage. Since this valuable commodity was limited to such an exclusive place, some enterprising people capitalized on it, and set up circuits of theaters across the country where acts could tour, living out of suitcases and hotels and performing in New York one night, Boston the next, and so on, all overseen by one centralized booking office.
That?s the structure of vaudeville. But it?s not what vaudeville is, no more than I am calcium or carbon or simply a moderately well-organized system of nerves.
It?s vague because it pulls its origins from English music halls and burlesque halls and beer halls: things that are an awful lot like vaudeville, but simply aren?t perpetrated on the same scale. And though everyone agrees that vaudeville died with the development of film, what most people forget is that it didn?t really die: it just got refracted.
Some vaudeville stars became silent movie stars, some of which went on to star in ?talkies,? when sound became more manageable. And vaudeville theaters did not suddenly collapse with the release of film: rather, many were slowly converted into the first movie theaters.
Vaudeville was not replaced by film: it was the space or stage that film came to occupy. The audiences who liked vaudeville were the people the film industry wanted to speak to. In a very direct way, vaudeville defined the early days of film, which of course defined every day after that.
There is, of course, the matter of a live art ? one performed in person, in the flesh ? being replaced by a dead one. But I don?t think this is apt, either. Because part of what gives vaudeville its allure is the profound giddiness of such bizarre acts being performed in front of a live audience.
And do you think that giddiness isn?t inherent in this scene, performed by veterans of vaudeville and English movie halls?
Watching this scene makes you realize that people came to movies to get the same things they got out of vaudeville: musical performances mixed with comedy and acting. They didn?t want just one thing or the other. But there was a certain type of musical performance people wanted to see: they wanted something unusual, and striking, which the group The Avalon Boys readily provide.
But the scene also communicates the sheer joy of seeing live music. Laurel and Hardy spent what would today be an unconscionable amount of time simply watching the music, and reacting to it. The audience watches an audience, for seconds and frames on end. Yet the passiveness of the scene is overcome by Laurel and Hardy?s evident delight at what is happening.
They love this. Seeing this music is doing something to them.
And what it does is inspire them to dance. And though to some this iconic scene may be unfamiliar, the number of remixes and manipulations found on Youtube say it?s a long way from being forgotten.
In fact, it?s not just enough to watch the dance. People want to dance with them.
Yes, you are seeing Tilda Swinton ? abstract, elite, aloof, intellectual Tilda Swinton ? dance the Laurel and Hardy dance in Edinburgh alongside hundreds of people. Here?s another angle, shot from a crowd member at the flash mob:
Vaudeville has never really died. It set the mold for nearly every touring band today: every band or act has a booking agent, whose career wouldn?t exist today if vaudeville hadn?t necessitated its creation. But it goes beyond structure: look at W00tstock, which describes itself quite aptly as ?nerd vaudeville.? Look at Human Giant, at Funny or Die, or Stella. Look at the Upright Citizens Brigade. These are all productions that want to relay to you not only humor, but the sheer delight of seeing such humor in real life.
Vaudeville is just one facet of the joy of the strange and unusual. This joy hasn?t ever died, nor will it. It just gets, like light, refracted, bent into other wavelengths and shot into different places, all of them rays of light, shooting into the dark.
That, of course, is not only the nature of vaudeville and performance, but the nature of The Troupe. At the heart of The Troupe is a song, and the song that must be sung on and on ? for if the song is not sung, then the world will fail.
The song has been sung in a variety of ways: it?s been sung in medieval courts, in Bunraku shows, in fields and in streets and mountains, until finally it?s found its way to vaudeville, where it tours the dives and slummy theaters, a splinter of the eternal gradually revealed in a world of drifting shadows.
The plot of the book is fiction, of course. But as for the conceit? sometimes I wonder. Possibly not.

Last week, the Indiana Senate voted unanimously to pass Senate Bill 315, authored by state Senator Randy Head (R-18).? Following the vote, this bill was sent to the state House and assigned to the House Public Policy Committee.? SB 315 will be heard tomorrow, so it is important that you contact committee members TODAY and urge their support!
SB 315 will streamline the licensing and reporting process for charity gaming events, such as Friends of NRA banquets, by:
1.? Establishing one comprehensive charity gaming license for national organizations and foundations for use by their local affiliates;
2.? Removing the current six-to-nine week application process and requiring in its place a 21-day notification to the Indiana Gaming Commission prior to an event; and
3.? Allowing qualified organizations and foundations to "police their own" by removing requirements to turn over volunteers' personal information to the Indiana Gaming Commission.
These policy changes would greatly improve the ability of Friends of NRA committees to comply with Indiana charitable gaming laws in a timely and less cumbersome fashion, while protecting the personal information of Friends of NRA volunteers.
As many NRA members well know, Friends of NRA banquets play a critical role in raising grant money to support education, safety, and training programs in communities across the Hoosier State, such as the Boy Scouts, 4H clubs, and local law enforcement groups. Unfortunately, some Friends of NRA chapters had difficulties holding banquets in 2011, which resulted in a net loss of approximately $100,000 in money that cannot be used for these Indiana groups.
Please contact members of the House Public Policy Committee TODAY, and respectfully urge their support of SB 315.

Two separate blasts kill 3, wound 18 in Iraq (AP)
BAGHDAD ? Two separate attacks against Iraqi security forces killed three people and wounded 18 others on Tuesday, officials said.
A bomb in a parked car exploded around noon near an Iraqi army checkpoint in the northern city of Mosul, killing a soldier and a bystander, a police officer said. Twelve other passers-by were wounded in the attack.
Sunni-dominated Mosul, located 225 miles (360 kilometers) northwest of Baghdad, was a major haven for al-Qaida in Iraq and other insurgent groups several years ago even as militant activity declined elsewhere.
Two hours earlier, a police patrol hit a roadside bomb in Baghdad's eastern neighborhood of Mashtal, killing a bystander and wounding six others, another police officer said.
Two doctors at hospitals in Mosul and Baghdad confirmed the respective casualties. All officials spoke on condition of anonymity because they were not authorized to speak to the media.
Violence has dropped considerably since the height of Iraq's insurgency just a few years ago, but attacks continue almost daily in Baghdad.

The Buffet rule won't work in practice - ydobly's posterous
According to the Buffett Rule the wealthy should pay at least as much tax as middle-income households.?That sounds straightforward but it?s not.
In his State of the Union speech, President Obama?s called for a new law that would require high-income people to pay at least 30 percent of their income in taxes. In response, Senator Sheldon Whitehouse (D-RI) and Representative Tammy Baldwin (D-WI) have introduced the Paying a Fair Share Act of 2012, a proposal designed to meet the Buffett Rule: That the wealthy pay at least as much tax as middle-income households.

That sounds straightforward but it?s not.
First, there?s the matter of how to measure income. The rule would define income as adjusted gross income minus a modified measure of charitable contributions. The adjustment avoids discouraging charitable donations.
Measuring taxes is more complicated. The proposal defines taxes to include the regular income tax, the individual alternative minimum tax (AMT), the employee?s share of payroll taxes that finance Social Security and Medicare, and the 3.8 percent tax on investment income and the 0.9 percent tax on earnings imposed on high-income taxpayers to help finance healthcare. That?s a broader measure than what most people see on their tax returns today, but it still excludes other taxes that people pay indirectly like corporate income taxes and the employer?s share of payroll taxes.
If you make at least $1 million (by the act?s definition) and your tax is less than 30 percent of that, you?ll owe more tax, presumably yet another addition on your income tax return. That?s certainly not tax simplification.
The Tax Policy Center estimates the proposal would increase 2015 taxes for about 116,000 households by an average of more than $170,000, assuming the Bush-era tax cuts expire as scheduled and Congress stops patching the AMT. That?s an overall tax increase of about $20 billion, not chump change but less than a tenth of the projected 2015 deficit. If Congress extends tax law in place this year, about 217,000 tax units would owe an average of nearly $190,000 more, yielding about twice as much additional revenue but still less than a tenth of a larger deficit.
The Buffett rule sounds good in principle. High-income taxpayers should pay at least as large a share of their income in taxes as the rest of us. But most already do. On average, middle-income households will pay 2015 taxes totaling about 15 percent of their income (using the legislation?s definition). Without the Buffett rule, more than 99 percent of millionaires will pay more than that and only about 4,000 will pay less. Barely 10 percent of them will pay less than 20 percent.
The proposed legislation would certainly raise taxes on a lot of high-income taxpayers. But the price would be even more complicated tax code. There are better ways?to raise taxes on the rich.
