A San Mateo County judge has denied a motion by a Clayton politician requesting that his embezzlement case be dismissed, according to prosecutors.
An attorney for Vice Mayor Joe Medrano has claimed San Mateo County authorities did not have jurisdiction over the case because Medrano never physically conducted business in San Mateo, instead communicating with a client there through email, phone and regular letters.
Judge Jonathan Karesh denied that request on Friday, according to District Attorney Steve Wagstaffe.
Prosecutors allege Medrano, 47, collected more than $159,000 in insurance premiums from iPass, a wireless network provider, between January 2009 and October 2010 and failed to forward the money to his parent company, Travelers Insurance. Medrano was acting as an insurance broker for iPass, which is located in the San Mateo community of Redwood Shores.
Medrano pleaded not guilty and has denied the allegations. He did not immediately return a call for comment Monday and his lawyer, Joshua Bently, is on vacation.
Medrano next appears in court on July 31 in Redwood City for a pretrial conference. His jury trial is set for Sept. 10.
